Limited Product Warranty & Disclaimers

KT Marine Services, LLC (“Seller”) expressly warrants to you, the original purchaser, that this product will be free from defects in material and workmanship for a period of one-year from the date of purchase. You must promptly notify Seller in writing during the warranty period that there is a defect in material or workmanship. If you return this product to Seller during the warranty period and Seller confirms that the product suffers from a defect in material or workmanship, Seller will, at no additional cost, repair or replace the item. You are responsible for all shipping charges and other costs associated with returning the item. In the event that Seller determines, in its sole and complete discretion, that an item cannot be repaired, Seller shall replace the defective item. Such repair or replacement is the sole and exclusive remedy regarding all products of Seller. Any replacement or repaired products are warranted for the remainder of the warranty period or ninety days (90), whichever is longer.

This limited warranty only applies to the original purchaser of this product and applies only to purchases that were made directly from Seller or an authorized dealer. This limited warranty is not transferable. A copy of the original receipt or other proof of purchase and proof of date of purchase must be included with the returned item. If you cannot provide proof of original purchase, including proof of purchase date, Seller may, in its discretion, deny coverage of this limited warranty.

This limited warranty is not available for any damage caused by normal wear and tear, unauthorized modification and repairs, accident, excessive exposure to heat, excessive exposure to sunlight, excessive exposure to cold, improper handling or maintenance, incorrect set up, any blow or impact with a hard object or any other misuse, abuse or irresponsible use.

This limited warranty applies only to this product and does not extend to any damage to any other product or property. Seller disclaims any liability for any damage to any other property, including but not limited to, watercraft, watercraft accessories, docks, ropes or lines, and any bodily injury resulting from the misuse, abuse, modification, or any use of this product that is not as intended or instructed.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EXCEPT AS EXPRESSLY STATED HEREIN, SELLER DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, ARISING BY OPERATION OF LAW, COURSE OF DEALING, CUSTOM AND PRACTICE, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR THE WARRANTY AGAINST REDHIBITORY DEFECTS OR VICES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SELLER BE LIABLE TO YOU OR TO ANY OTHER BUYER OR USER FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES FOR PERSONAL INJURY, LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THIS PRODUCT, EVEN IF SELLER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential damages, the above limitation may not apply to the purchaser.

Safety Warnings

IT IS YOUR RESPONSIBILITY TO STUDY THE PARTICULAR HYDRODYNAMICS AND MECHANICAL NEEDS OF YOUR BOATS AND EVALUATE SELLER’S PRODUCTS FOR FITNESS AND APPLICABILITY FOR USE WITH YOUR PROPERTY, INCLUDING THROUGH A TESTING PROGRAM AS MAY BE NECESSARY OR APPROPRIATE.

ANY MODIFICATIONS OR ADDITIONS TO YOUR VESSEL OF ANY KIND COULD PRODUCE A FAILURE OF ONE OR MORE COMPONENTS ON YOUR VESSEL. AS WITH ANY MODIFICATIONS TO A BOAT, INSTALLING THIS PRODUCT ENTAILS AN UNCERTAIN DEGREE OF POSSIBLE FAILURE. BY YOUR PURCHASE AND INSTALLATION OF THIS PRODUCT YOU ACKNOWLEDGE AND ACCEPT YOUR UNDERSTANDING AND ASSUMPTION OF THIS RISK.
